Nintendo being sued?I don't have much information, but it seems a guy named Patrick Goschy, former Midway employee, is suing Nintendo for copyright infringement. He claims that he created a motion sensing controller and patented it in 1999, and made a public demonstration in 2000. The sue didn't get to court yet.

It would be patent issues, not copyright, and from what I understand after googling the guy, he’s not actually suing, just trying to claim due credit in the court of public opinion. He doesn’t really have any legal grounds to sue, as Midway owned the patents for his inventions, not him. It seems likely that Nintendo bought or leased the patents from Midway, as they allegedly cited one of those older patents in the application for the Wii Remote.

If he did invent this, why did he wait so long to act? It would have been rather obvious...
Perhaps I am severely mistaken, maybe Patrick invented a controller that had gyrometers, optical sensors, accelerometers, infared sensors, etc., etc., etc. But most likely he is just a loser looking for attention. Furthermore, he can't really sue Nintendo, as Nintendo told Gyration to make them the Wiimote, after licensing a lot of motion sensing patents from Gyration. |

As I pointed out, he is not suing because he can’t. He is only seeking general recognition, not legal recognition nor money.

What’s so loser-ish about a brilliant inventor looking for a little attention? It sucks that he lost out on all the money, so I really can’t say I blame him for wanting to be publically known. Maybe it will get him a job somewhere, and he will make some money, which he deserves if he really thought up something like that. He can’t even afford a Wii right now, apparently.

He didn't make it, that is what is so ridiculous. Had he made it, he would have recognized rather quickly that his design was, indeed, being used.
His first patent was issued Nov. 13, 2001. Wiimote development started in early 2001. Since no one seems to know this, his controller is an wired accelerometer in a light gun. Hmm, seem to be quite a few differences, eh? Where is the optical infared sensor? It doesn't communicate through bluetooth either. Motion sensors? None of those either. And it has one button. Wait, doesn't Wiimote have, y'know, more? Either way, Nintendo bought the rights from Midway anyways, so he doesn't deserve any recognition. Thats like saying PS3 controller and Wiimote are exactly the same. They both have motion sensors in some form, right? They must be completely alike! |
